Legality is a core pillar of the due diligence required under the European Union Deforestation Regulation (EUDR). Operators must verify that commodities were produced in compliance with the relevant legislation applicable to the area of production.
The Commission committed to develop an official repository of relevant producer country legislation by the end of the year. This digital platform will be a practical tool facilitating companies to comply with EUDR legality due diligence requirements and help competent authorities and other actors like NGOs to assess EUDR compliance.
It is yet unclear how the process of populating the repository will work, which ministries, agencies or other stakeholders like CSOs in producer countries will be involved and how possible disagreements will be resolved.
During the session the latest updates about the development of the legal repository will be shared. Representatives from civil society in Liberia and from Indigenous Peoples in Brazil will share their expectations of inclusion in the process of defining what legality means for different commodities and regions, and to ensure that the legal domains related to land rights, human rights, environmental protection, FPIC and labour rights are properly reflected.
